Mother awarded $1.5 million after winning case against Zumbro Valley Health Center following son’s death

In 2021, a Red Wing mother named Jill Adams won $1.5 million in a lawsuit against Zumbro Valley Health Center for the death of her son, Caleb Malek. At the time of his passing, Malek was 23 years old and had tested positive for fentanyl, Percocet, and THC while living in a sober living home. He then sought detox treatment at Zumbro Valley Health Center.

Court records show that jurors found Zumbro Valley Health Center negligent in its care and treatment of Malek. The lawsuit claimed that employees failed to adhere to the policy of checking on Malek every 15 minutes and did not adequately screen him for drugs upon admission. Additionally, it was alleged that Zumbro Valley failed to train its staff to recognize signs of a breathing problem, which may have contributed to Malek’s death.
