AI Regulation: Balancing Innovation and Human Autonomy in the Digital Age

The Council of Ministers has passed a bill on artificial intelligence aimed at bringing order to an industry with multiple applications, from healthcare to information to security and defense. The bill includes provisions such as imprisonment of up to five years for those causing unjust harm using AI systems, as well as mandating that systems like chatbots be registered for use by individuals under 14 only with parental consent.

The goal of the bill is to establish limits on the use of AI, ensuring that systems are developed and applied with respect for human autonomy and decision-making. The document stresses the importance of cybersecurity and states that AI systems should not compromise democratic processes. Furthermore, the text highlights the need to safeguard freedom of expression, information, and communication.

The Minister of Justice has underscored that AI systems must not interfere in criminal activities and that an aggravating circumstance may apply to crimes involving AI. Meanwhile, the Minister of Business has announced one billion euros in funding for startups in the AI sector, aiming to create a level playing field while promoting innovation.

Developed in collaboration with various officials and experts, the bill outlines a national strategy for AI development that will be updated regularly and monitored by designated authorities. It seeks to bridge the gap between public and private entities, promote research, and establish an industrial policy on AI. Above all, it prioritizes human well-being and aims to create a national champion in the AI sector.
